These Terms of Service ("Terms") govern your use of the Real Estate AI Assistant, including the Telegram assistant, the web dashboard, onboarding and support (together, the "Service"). By starting a trial, subscribing, or using the Service, you agree to these Terms and to our Privacy Policy. If you're accepting for a company or brokerage, you confirm you can bind it, and "you" means that company.
Summary of subscription terms
- Free trial: 30 days. $0 due today. A payment method is required at signup.
- Then $450 USD per month, plus any applicable sales tax, charged automatically to your payment method starting on day 31 and every month after that until you cancel.
- Cancel anytime by emailing brian@bcg-ventures.com. Cancel before the trial ends and you won't be charged. After that, cancellation takes effect at the end of the current paid month; no partial-month refunds.
1. The Service
1.1 What it does. The Service is AI software that helps real estate agents track transactions and deadlines, read and answer questions about documents you provide, research properties, watch email, manage calendar items and scheduled briefings, and draft messages and documents, using accounts you connect.
1.2 Eligibility and business use. You must be at least 18 and use the Service for your real estate business. The Service is built for Texas practice (TREC/TAR forms, Texas deadline math, Texas water-district data). Use outside Texas is at your own risk unless we agree otherwise in writing.
1.3 Your accounts and logins. The Service works through accounts you connect (for example Gmail, Google Calendar, Google Drive, Canva, Telegram) and any MLS or research logins you give us (for example HAR or RPR). You confirm you're allowed to connect them and to let the Service use them on your behalf, including under your brokerage's policies and those services' terms. You're responsible for access you grant and can revoke it anytime.
1.4 Changes to the Service. We may improve, change or discontinue features. If we remove a core feature you rely on, you may cancel and we'll refund any prepaid amount for the unused part of the current month.
2. Trial, billing, auto-renewal and cancellation
2.1 Free trial. New customers get one 30-day free trial. We collect your payment method through Stripe at signup. We will not charge you during the trial.
2.2 Automatic renewal. Unless you cancel before the trial ends, your subscription starts automatically on day 31 and renews every month at $450 USD plus applicable sales tax, charged to your payment method on file, until you cancel. By completing checkout you authorize these recurring charges.
2.3 How to cancel. Cancel anytime by emailing brian@bcg-ventures.com. We'll confirm cancellation by email within one business day. No calls, forms or retention steps are required.
2.4 When cancellation takes effect. Cancel during the trial and you pay nothing. Cancel after that and you keep access until the end of the month you've paid for; you won't be charged again. Monthly fees are non-refundable except where these Terms or the law say otherwise.
2.5 Reminders. We'll email you before your trial converts to a paid subscription, and before any price change.
2.6 Price changes. We'll give at least 30 days' email notice of a price change. It applies from your next billing date after the notice period. If you don't want it, cancel before then.
2.7 Failed payments. If a charge fails, we'll let you know and may retry. If it isn't resolved within 14 days we may suspend the Service until it is.
2.8 Taxes. Fees don't include taxes. You pay any sales or use tax that applies; we'll show it on your invoice.
3. AI output: you stay in charge
3.1 The Service can be wrong. It uses artificial intelligence, which can produce inaccurate, incomplete or outdated results, including wrong dates, deadlines, dollar amounts, contract readings, property data and drafts, and can misread documents or emails.
3.2 You review before you rely. You are responsible for checking every deadline, date, amount, contract term and piece of property data against the source documents before relying on it, and for reviewing anything before it goes to a client, other party, lender, title company or anyone else. Deadlines calculated by the Service are an aid only; the executed contract and applicable rules control.
3.3 Not a professional service. The Service is not a licensed real estate broker, sales agent, inspector, appraiser or transaction coordinator, and it does not give legal, tax, financial or lending advice. Nothing it produces creates an attorney-client or other professional relationship. You remain responsible for your license duties, your brokerage's rules, and your clients.
3.4 Actions you allow. You choose, during onboarding and anytime after, what the Service may do on its own (for example send an email or create a calendar event) and what needs your approval. You are responsible for actions taken within the permissions you set.
3.5 Third-party data. Property, MLS, MUD and water-district information comes from public sources and third-party services we don't control. We don't guarantee it's accurate, complete or current.
4. Your data
4.1 You own your data. Documents, emails, messages, deal files, notes, preferences and other content you or your connected accounts provide ("Your Data") stay yours.
4.2 Our use of Your Data. You give us permission to process Your Data only to provide, support, secure and improve the Service for you, and as described in our Privacy Policy. We don't sell Your Data or use it to train AI models. To provide the Service, Your Data is processed by AI model providers described in the Privacy Policy. Their terms or our account settings don't let them train on it, and each provider's own terms apply to retention.
4.3 Other people's information. Your Data will include personal information about your clients and others in your transactions. You're responsible for having the right to share it with us for this purpose, including any notices your clients need. We'll handle it as your service provider, only on your instructions and as these Terms and the Privacy Policy describe.
4.4 Security. We use commercially reasonable administrative, technical and physical safeguards designed to protect Your Data. Logins saved in the dashboard's Password Vault are stored encrypted and aren't shown to the AI model. Don't send passwords in chat; a password sent as a message is handled like any other message. No system is perfectly secure. We'll notify you without undue delay if we learn of a security incident affecting Your Data, as required by law.
4.5 When you leave. After your subscription ends you may ask for a copy of your deal files and documents within 30 days. We'll disconnect your connected accounts and delete stored logins within 7 days, and delete Your Data within 30 days after the subscription ends, except records we must keep by law. We don't keep backups of your assistant, so deleted data can't be restored.
4.6 Feedback. If you send us suggestions, we can use them without owing you anything.
5. Acceptable use
You won't: (a) use the Service to break the law, including fair housing, anti-spam, privacy or real estate licensing laws; (b) send unsolicited marketing through it; (c) connect accounts or logins you're not authorized to use, or share MLS data in ways your MLS rules forbid; (d) try to access other customers' data, probe or bypass security, or reverse engineer the Service; (e) resell or share your subscription outside your own business; or (f) use it for decisions that the law restricts to humans without the required human review. We may suspend the Service to stop a violation or a security threat, and will tell you why unless the law or the threat prevents it.
6. Third-party services
The Service depends on services we don't control (for example Google, Telegram, Canva, Stripe, HAR/RPR and AI model providers). Your use of them is governed by their own terms. We're not responsible for their outages, changes, or loss of access they cause, though we'll work to restore features when we can.
7. Intellectual property
We own the Service, including its software, prompts, workflows and design. We grant you a non-exclusive, non-transferable right to use it for your business while your subscription is active. Drafts and documents the Service creates for you are yours to use, subject to any third-party content in them.
8. Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, BCG DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL CATCH EVERY DEADLINE OR EMAIL.
9. Limitation of liability
9.1 Cap. TO THE FULLEST EXTENT THE LAW ALLOWS, BCG'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF THE FEES YOU PAID BCG FOR THE SERVICE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE THOUSAND U.S. DOLLARS ($1,000).
9.2 No indirect damages. TO THE FULLEST EXTENT THE LAW ALLOWS, BCG IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, COMMISSIONS, EARNEST MONEY, DEALS OR CLIENTS, OR MISSED DEADLINES, EVEN IF TOLD THEY WERE POSSIBLE.
9.3 Where limits don't apply. Some laws don't allow some of these limits; in that case they apply to the extent allowed.
10. Indemnity
You'll defend and indemnify BCG against third-party claims arising from (a) Your Data, including your right to share it; (b) your use of output without the review required by section 3; or (c) your breach of section 5 or the law.
11. Term and termination
These Terms apply while you use the Service. You may cancel as in section 2. We may end your subscription for any reason on 30 days' notice (with a pro-rated refund of prepaid fees), or immediately if you materially breach these Terms or don't pay. Sections 3, 4.5, 4.6 and 7–13 survive.
12. Governing law and disputes
12.1 Texas law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.
12.2 Informal resolution first. Before filing a claim, email us at brian@bcg-ventures.com and give us 30 days to try to resolve it.
12.3 Venue. Any claim must be brought in the state or federal courts located in Fort Bend County, Texas, and both parties consent to their jurisdiction. Either party may bring a qualifying claim in small-claims court.
12.4 Time limit. Any claim must be brought within one year after it arises, to the extent the law allows.
13. General
These Terms and the Privacy Policy are the whole agreement for the Service and replace any earlier statements about it (including website FAQ text). We may update these Terms: we'll email you at least 30 days before a material change takes effect, and it applies from your next billing period; if you don't agree, cancel before then. Notices to you go to your account email; notices to us go to brian@bcg-ventures.com. You can't assign these Terms without our consent; we may assign them to a successor to our business. If a provision is unenforceable, the rest stays in effect. Not enforcing a right isn't a waiver. Neither party is liable for delays caused by events beyond its reasonable control.
